Court of the state of new York did not allow the property trump to cancel the program protecting illegal immigrants

NEW YORK, February 14. /TASS./ Court, Eastern district of new York on Tuesday decided to temporarily resume the program for the protection from deportation of illegal immigrants who entered the U.S. minors (Deferred Action for Childhood Arrivals, DACA). This decision was made by district judge Nicholas Garaufis handling the lawsuit filed against the Department of homeland security (DHS).

“The defendants would certainly be able to undo the DACA program. However, the court did not deal with this issue, and has provided defendants adequate grounds for such cancellation . Based on a review of information provided, the court came to the conclusion that the defendants are unable to do it,” explained Garaufis.

He considered that the administration of U.S. President Donald trump in the face of DHS “comes from the inaccurate, with the actual point of view, the promise of illegality” DACA. “Since 2012, the programme has benefited nearly 800 thousand people to work, learn and build their lives in our country,” said the judge.

A similar verdict rendered in late January, a Federal court in San Francisco (California). The Ministry of justice sent to the U.S. Supreme court a petition calling to reverse the decision of the lower court, describing it as wrong from a legal point of view.

In September last year, the White house announced the decision to cancel the program DACA, introduced the predecessor to trump Barack Obama. Minister of justice Jeff sessions was then called a circumvention of the provisions of the immigration law, saying that the cancellation of the DACA process will take six months. The Congress of the United States were invited during this time to develop alternative program. After that, more than 10 States have filed in court with the requirement to recognize cancellation of DACA invalid because, in their opinion, such a move violates the legal rights of immigrants.

When Obama introduced DACA was extended to foreigners who are on American territory illegally and who were less than 31 years as of June 2012. To fall within the scope of the program, the alien must have been under 16 years of age at the time of entry to the United States and live in the country continuously since June 2007. DACA allowed to legally avoid deportation about 800 thousand foreigners.
